The Juvenile Justice System is a system modeled to provide a legal setting where youths account for their wrongs or are offered official protection. A distinct juveniles justice system commenced in the United States over 100 years ago. The first juvenile court was established in 1899. The system is founded under a range of core principles. First, juveniles are different from adults and hence need to be handled differently by the Justice System. Second, it is argued that juveniles differ from one another. Therefore, juveniles require individualized treatment depending on their unique circumstances and situations. The idea of juvenile justice quickly spread in the United States (ABA Division for Public Education, 2017, p.5). Difference between the Juvenile and Adult Criminal Justice Systems The juvenile justice system differs from the adult criminal justice system in several ways. Firstly, it focuses on the adolescent or child as an individual in need of assistance instead of the act that resulted in him or her being brought before the judge or magistrate. In contrast, the adult criminal court concentrates on determining the guilt of the adult for the act that led to him being brought to court. Further, proceedings are informal on the juvenile justice system. The judge is given discretion because he/she is expected to act in the child’s best interest. There are procedural safeguards given to adults such as the right to know one’s charges, the right to legal counselright to be tried by a jury of one’s peers, and the right to challenge the accuser. These procedural safeguards were deemed unnecessary in a juvenile justice system (McCord, Widom, Crowell, 2001, p.154). More so, proceedings of a juvenile court are not open to the public. Sanford Maryville University Middle Range Theory Continues to Guide Nursing Practice Nursing theory has three distinct categories to describe the level of abstraction: Grand, Middle-Range, and Situation-Specific (Meleis, 2012, p. 33). Middle-range theory is more focused and is normally the end product of a research study. Narrow-range theory is even more specific and while also being based on research findings, it guides specific actions in the achievement of desirable goals (p. 17). When thinking about nursing theory, one might ask: What is the purpose of theory? Is it even relevant to current nursing practice? The best response to answer these questions I have found is from Meleis (2012): The primary uses of theory are to provide insights about nursing practice situations and to guide research. Through interaction with practice, theory is shaped and guidelines for practice evolve. Research validates, refutes, and/or modifies theory as well as generates new theory. Theory then guides practice (p. 35). This explanation of theory by Meleis identifies nursing as a profession. Without theory to shape and guide nursing practice and research, nursing would not evolve and would remain stagnant. Additionally, without theory could nurses really claim that we are a profession? I think not. I believe that theory is necessary for the identity of nursing as a profession verses a vocation. The nursing profession as a whole has had issues with identity for various reasons. I believe this to be true in part due to the numerous educational ways of entering the profession. I cannot think of any other field where one could earn either a diploma, two-year associate’s degree or a four-year baccalaureate degree as a starting point into a profession. The educational debate still continues, however, in recent years more emphasis is being made to have the baccalaureate nurse the entry level of the nursing profession. Evidence from research has suggested that the baccalaureate-prepared nurse is associated with a five percent lower mortality rates in both the likelihood of patients dying within 30 days of admission and the odds of failure to rescue in hospitalized clients (Aiken, Clarke, Cheung, Sloane, Silber, 2003, p. 1617). This research study was conducted because nursing is a profession. Would research in nursing even exist if there were no theory? All in all, taken to its end, the loss of theory could mean the demise of nursing as a profession. When reflecting on current trends of clinical practice, I feel that middle-range theories are more applicable. Middle-range theories are broad enough to incorporate in everyday clinical practice for the average floor nurse without being too narrow in scope as the situation-specific theories. Additionally, middle-range theories are less abstract than grand theories and are easier to relate to and put into practice (Liehr Smith, 1999, p. 85). One example of applying middle-range nursing theory into practice is patient education. Patient education is a major focus of the clients I serve post transplant. It is imperative that a newly transplanted client understand his/her medications that are such an integral part of their new life in order to maintain the transplanted organ. â€Å"Caring through Relation and Dialogue: A Middle-Range Theory for Patient Education is derived from the two disciplines of nursing and education† (Sanford, 2000, p. 8). According to Sanford (2000), A middle-range theory addressing the phenomenon of patient education through caring can add clarity and direction to this area of concern for nursing, and it can provide an opportunity to link theory, practice, and research (p. ). Caring and dialogue are described in this theory as follows: Dialogue is a process of naming our world. It is a process that opens the possibility for participants to pose problems, to critically reflect, and to perceive solutions not previously realized. This process occurs within a caring relation where the carer and the cared-for exhibit receptivity and engage in â€Å"reflect ion, invitation, assessment, revision, and further exploration† (p. 9). Another example of the applicability of middle-range theory is the theory of care transitions. A hot topic in today’s times involves hospital acquired conditions (HACs) and readmission rates. Medicare expenditures are estimated at $15 billion annually due to readmissions (Averill, et al. , 2009, p. 1). As a result, policymakers have implemented the The Deficit Reduction Act of 2005, which eliminates any increase in hospital payments due to the occurrence of HACs. Furthermore, it is viewed that high readmission rates are a reflection of poor quality, and ospital payments for readmissions were recommended in the FY2010 budget from the Obama Administration to reduce payments for readmissions as one way of controlling Medicare expenditures (Averill, et al. , 2009, p. 1). As a staff nurse, I am all aware of the importance of HACs and the importance of diligent documentation. For example, when a client is admitted a thorough assessment is completed. Wounds and skin breakdown are crucial to document upon an admission or a transferred client to our division. If the documentation of skin assessment is not completed correctly, then the â€Å"blame† is placed on our unit for an ulceration if it was not charted within 24 hours of admission. What are the causes or issues that surround care transitions? Increasingly fragmented care is one reason associated with hospital readmission rates. Issues include communication breakdowns related to plans of care, unclear expectations, uncertainty about illness trajectories, lack of continuity in medical follow-up, and incomplete or inaccurate understanding of medication regimens (Geary Schumacher, 2012, p. 237). In my practice of nursing, the utilization of inpatient care management for clients begins upon admission in preparation for discharge. A multidisciplinary approach of the transplant team includes the doctors, inpatient nurses, social workers, dieticians, case coordinators, post-transplant coordinators, and transplant pharmacists working together to coordinate and ensure continuity of care upon discharge. According to Geary Schumacher (2012), â€Å"Through the transition process, agents act and interact within relationship with each other, causing emergence of new behaviors and outcomes. Just as important, through supportive dialogue and discussion, sensemaking is enabled for everyone involved in the transition, effectively reenvisioning multiple understandings of the situation and changing outcomes for the better† (p. 246). Middle-range nursing theories can be viewed as a cookbook for nursing. There are many recipies in the middle-range theories which can be utilized by the average hospital-based nurse in a variety of ways. In any given 12-hour shift of a nurse, there are several theories which can be applied to specific situations. I have unknowingly used nursing theory in my practice over the years. This course has brought to my attention the diverse ways in which I have used middle-range nursing theories and has given me a better understanding of how nursing theory is applied to current clinical nursing practice. To Act Or Not To Act Essay In William Shakespeares tragic play Hamlet, the main character, Hamlet, struggles with procrastination throughout the play. As Samuel Taylor Coleridge said, No brilliant intellect can be considered valuable if one withdraws from action. It is this tragic flaw of inaction that eventually brings about Hamlets downfall. In the beginning of the play, Hamlet is given explicit instructions by the ghost to kill his uncle/step-father Claudius to avenge his fathers murder; yet, he fails to do so. Hamlets inaction and hesitation to kill Claudius is justified in his own mind and to the audience. Hamlets initial disbelief in the reliability of the ghosts claim, Hamlets belief in religion, and the fact that Hamlet is trained in thought rather than in action, all lead to Hamlets inaction, and ultimately, Hamlets downfall. The ongoing duel between Hamlets procrastination and his final action begins with Hamlets perception of the ghost. The ghost appears in form, as Horatio describes it, a figure li ke your father, armed at point exactly (1.2.209-210). When Hamlet first meets the ghost, he immediately calls the ghost by his fathers name and follows it to where the ghost beckons him. In response to the ghosts claim that the serpent that did sting thy fathers life now wears his crown, Hamlet answers, O my prophetic soul! (1.5.46-48), revealing that Hamlet has already contemplated this possibility. The ghost does little to persuade Hamlet of the cause of his fathers death because Hamlet is already convinced of his uncle/step-fathers guilt due to his great distrust and dislike for Claudius. Although at first, Hamlet reacts with anger, a thirst for vengeance, and grief, Hamlet becomes suspicious of the ghosts origin. He begins to wonder whether the ghost is a devil, an angel, or a sign of Hamlets own grief. Hamlet says the spirit that I have seen may be a devil, and the devil hath power tassume a pleasing shape; yea, and perhaps, out of my weakness and my melancholy, as he is very potent with such spirits, abuses me to damn me (2.2.627-632). Fearing deception, Hamlet has doubts, which initiate his inaction. His hesitation is somewhat resolved in the form of a play. In order to test the truth of the ghost, Hamlet devises a scheme to perform a play to catch the conscience of the King(2.2.634), by reenacting a scene similar to the events recounted by the ghost about King Hamlets murder, in order to prove Claudius guilt. Here, Hamlets inaction results not only from his distrust of his fathers apparition, but from his distrust of his own senses. Had Hamlet trusted his father in death as he had in life, Hamlets life would never have resulted in such a tragic end. In the in vitro part of the study, a test model (mounted in an articulator and in a universal testing machine) was established with the use of maxillary and mandibular dentate casts. Articulating papers, foils, silk strips, and the T-Scan system were used to examine the loss of sensitivity of the recording materials after 3 consecutive strokes. The differences in the contact points of the test model determined by each of the re cording materials were evaluated both in the articulator and in a universal testing machine. Authors concluded that multiple use of the recording materials tested may lead to inaccurate occlusal analysis results. It is recommended that the recording materials be used only once and that the teeth be dry during occlusal analysis. Foil12 Foils are the thinnest indicator materials. But is that passion of yours not worth giving a shot? If no is your answer, then forget about it; it was not your true passion in the first place. Some say they are not really passionate about one particular field or thing. These ‘some’ can be categorized into two categories, namely the ‘doers’ and the ‘despisers’. The doers are the ones are who enjoy almost everything they do that they cannot put their finger on one as their passion. So, it is highly unlikely that you find a doer, disliking what they do, while the despisers are quite the opposite. They are those who have a complaint against most things around them that they do not see the point in being passionate about anything. The reasons behind such an attitude of theirs could be rooted to their family upbringing, huge disappointments despite a lot of hard work or merely the fact that they are sensitive-perfectionists who possess an utopian vision of the world and hence, hate it when even when the tiniest of things is out of place (by probably a few millimeters, if we were to measure it). At this point, I certainly agree with what the great Lincoln once quoted, â€Å"Most folks are as happy as they make up their minds to be†. The despisers seem to have a problem at every step, at every sight. They, sadly, fail to look at the brighter side of things. They should be able to come to terms with the fact that nobody and nothing is perfect. Since we are the cause of our own happiness, the onus is upon us as to whether we view the glass half empty or half full or (like the Gujarat Chief Minister) as half filled with water and the rest with air. Now, on re-analyzing the opening quote, I have come to realize what it could also mean†¦ In case, you are unable to do what you really love, then start loving what you are doing at present. In the process, you end up doing what you love. If you’re the engineer, then remind yourself that it is the job that you are more interested in than your boss’ scornful words and hope and pray against all odds that your boss is in a good mood today or that someday you can grow deaf to only his words (the mean ones, not the ones with instructions). If you’re the teacher, then you should jolly well know that not all students are alike and have an interest in the subject, and hence, must be cut some slack. And if you’re the student then, take yourself down a few years, back to when you were a little, kindergarten kid, and the starry-eyed expression that you bore whenever the teacher narrated a story. That story was completely new to you yet, you loved to know what happened next. Bring this child back into you the next time you are preparing for an exam. And for this reason, there is still a ray of hope, rather, many rays of hope for those despisers- hope that soon, they will start loving what they do and prove to the world at large, that we truly are the ‘dominant’ ones. And once you have found your passion (or if you are the passionate-one who’s reading this article) then there’s one piece of advice I could give you, something that I stumbled upon on the internet- When there is something you really want, fight for it; don’t give up no matter how hopeless it seems. And when you’ve lost hope, ask yourself in ten years from now†¦ you’re going to wish you had given it just one more shot because the best things in life, they don’t come free! Coca-Cola was invented by Dr. John Pemberton, an Atlanta pharmacist. He concocted the formula in a three legged brass kettle in his backyard on May 8, 1886. Coca-Cola debuted in Atlanta's largest pharmacy, Jacob's Pharmacy, as a five cent non- carbonated beverage. Later on, the carbonated water was added to the syrup to make the beverage that we know today as Coca-Cola. Coca-Cola was originally used as a nerve and brain tonic and a medical elixir. Coca-Cola was named by Frank Robinson, one of Pemberton's close friends, he also penned the famous Coca-Cola logo in unique script. Dr. John Pemberton sold a portion of the Coca-Cola company to Asa Candler, after Pemberton's death the remainder was sold to Candler. Pemberton was forced to sell because he was in a state of poor health and was in debt. He had paid $76.96 for advertising, but he only made $50.00 in profits. In the newspapers, he would give away coupons for a free Coke at any fountain. Coca-Cola was sold after the Prohibition Era to Ernest Woodruff for 25 million dollars. In 1931, he introduced the Coke Santa as a Christmas promotion and it caught on. Candler also introduced the twelve ounce Coke can in 1960. The Coca-Cola contour bottle was patented in 1977. Woodruff did have one dubious distinction, he raised the syrup prices for distributors. But he improved efficiency at every step of the manufacturing process.
